I applied for DLA for my 2 year old back in February as she requires significantly more care and attention as a result of suffering from chronic constipation.

I've been verbally told over the phone 2 weeks ago that her DLA was declined but I've still received no letter about this.

The decision maker had stated that as my daughter only takes movicol she is able to manage her condition effectively. In addition, they have said most 2 year olds can suffer with chronic constipation.

I'm so disappointed with this decision and plan to submit an MR.

Any advice on this would be appreciated as I'm so deflated just now.

So there are two issues that the Decision Maker has raised.

The first is the use of over the counter medication, I think there would be an expectation that there should have been some kind of medical intervention. Did you speak to her doctor and would they be willing to state that their preferred solution was the Movicol?

The second is more complicated and I am not in a position to comment on it. DLA for children considers the excess care needs a claimant has over children of the same age. Can you show that your daughter's problems are significantly greater than other two year olds?

I think when a child is so young it's quite difficult to show that their needs are so much greater than any other child the same age as when they are two they are pretty much dependent on you for everything despite any additional needs.
Do you have any additional health professionals involved besides the GP and HV? My eldest had chronic constipation and he was under the care of a paediatrician and a dietician. Can you ask the GP to make referrals? With additional medical evidence you might satisfy DWP that the needs are over and above a typical two year old.
Did you detail the impact of the chronic constipation on your child's care needs? The requirement of them to drink enough liquid and the time and effort this involves and the leakage and the multiple nappy changes? I would say that four nappy changes a day is pretty typical at two so you would need to detail how many more you change but then the aim of movicol is to clear a backlog so the extra nappies should be shortlived and DWP would want to know that it's a longterm impact.
Around here the HV can refer to the continence service at four who provide free nappies. You could ask HV when they could refer in your area.

My daughter was prescribed Movicol via the consultant peadatrican who she is under the care of.

The Movicol isn't helping with the chronic constipation and we are having to soothe her for 20-25 minute episodes when She is in agony with constipation.

My daughter is in tears and screaming in pain and severely distressed.

This isn't something the average 2 year old has to endure multiple times each day.

This is also happening multiple times every day and during the night.

The nappies are sometimes soiled but sometimes not.

I have already included the letter from the consultant but it hasn't been referenced at all in the decision.

Would you say on this basis an MR is justified?
