Following a pip award LCWRA entilement.

Following a number of years on UC and rated as LCW I was invited to a "Tailoring up session" in March 2023. I was advised by the person running the course to apply for a pip following a short discussion. Accordingly I applied with the assistance of Disability First.

I have since been awarded a pip with the enhanced rate for daily living needs and standard rate for mobility needs. This was backdated to mid March when awarded in late June.

I have been advised that I should be able to request an upgrade from LCW rate of Income Support to that of LCWRA which is higher.

Please can you advise if I am automatically entitled to an LCWRA uplift? A call to UC help line advised it was up to my case agent?

Hi Kirkham

PIP and LCWRA are not linked, although a few of the descriptors do cross over. PIP is about disabilities and how they affect the claimant, LCWRA is all about work and there are two tests to pass to be eligible.

What you need to do is contact DWP and report a change in circumstances, if you are successful then it will be backdated to your phone call. A new claims form will be sent to you, get your adviser to help you complete the new claims form, you will of course have another telephone assessment.

I have followed your proposal and advised DWP of the pip award and requested a LCWRA review.

I have been advised that a pip with the enhanced rate for daily living needs automatically triggers the LCWRA level with respect to Pension Credits. I am entitled to apply for my state pension/pension credit position next month.

The DWP response
"In regards to the LCWRA, you will receive an invite to be reassessed. We do not know when this will be as it is dealt with by CHDA. "

In terms of expediency and to avoid yet further anxiety, stress and mental concern would you consider it prudent to effectively by- pass the CHDA request and apply for the pension credit process in knowledge that the LCWRA rate will prevail?

I am somewhat perplexed with your post as LCWRA (Limited Capability for Work Related Activity) is associated with Universal Credit and not Pension Credit.

As stated in my previous post, LCWRA is not associated with PIP, they are both different benefits.

Depending on your circumstances, if you are in receipt of the daily living component of PIP then if you claimed Pension Credit Guarantee you may be eligible for an extra premium called a Severe Disability Premium (SDP)
