Hi, does anyone know the correct procedure to challenge the amount of transitional protection awarded upon managed migration from legacy benefits please. I have challenged the amount awarded as its £275 less than legacy benefits however i have been told that the system calculates it automatically so it is correct, which it definitely is not. I have given them a breakdown of our previos entitlement and shown it is not correct but they wont budge, so how do i challenge this and get them to look at it properly rather than give me a stock answer. Any help gratefully received.

Hi bubbles,
You can either make the complaint to UC yourself or you can ask for help from a local Benefits Advice agency.
If you use a local Advice Agency they are usually NAWRA members and will have access to the NAWRA Transitional Protection Calculator which is an excel spreadsheet created by their member Charles. Having done the TP calculation they will also help you with your complaint.
If you complain yourself you will need to send a Journal message explaining that the Transitional Protection has been calculated incorrectly and you are requesting a Mandatory Reconsideration.When you have typed the message from the drop down choose " Payment". If it was me I would type the message again and this time choose the option " Service Issue ". Just to make sure it gets there. Also take a screen shot of the message.
You could also use the CPAG free resources for challenging the DWP. See links here ---

thank you for your help, thats great. I have already messaged through the journal ad sent to payments, who does it go to if you select service issue?
I have also sent off a mandatory reconsideration in writing with proof of benefit entitlement on legacy benefits, hoping that they will actually look at it and see the shortfall.
Any idea how long they take to respond these days to mandatory reconsiderations?
also i was wondering if anyone knew how long Serco are taking to process WCAs at the moment.

Hi bubbles,
Selecting Service Issue means that the issue will be routed to a competent person such as a Performance Engagement Manager.
The DWP state that they are not obliged to work to time limits for a Mandatory Reconsideration.
I don't have any stats for Serco. Maybe other members can share their experiences.
