Council Tax Increase as a Result of Migration to UC was created by fruitbat
Hi
I have received my migration letter confirming I have moved to UC from ESA. I will receive transitional protection of £41.12 for a year, in other words the amount I'm getting has gone down by £41.12, but they'll honour it for a year, after that tough! Not great, but I can absorb that. However I just received my Council Tax ammendment: I now have to pay £93.00 per month!!! So my income per month is not protected, it's just gone down by £93.00.
I've phoned the council and, as they are using the correct UC figure, there's nothing they can do. I REALLY need some advice over this. There seems little point in appealing as the council are using the correct figure. I'm a single mum, who's disabled, with no family support. This is a huge blow. I feel utterly sick and I'm shaking.
Any help would be appreciated.

Hi fruitbat,
It is possible for this to happen but to check that they haven't made a mistake we need to know why.
Every Council in the UK is allowed to make changes to the Council Tax Reduction scheme.
Firstly I think you need to phone them to find out why this has happened. If they cannot answer then get the email address for Council Tax Reduction and question them.

I have just had the same experience. I've just finished migration, in fact I received first UC payment today, and received a £244 council tax bill. My council tax support has gone from 100% to 15% as it's based on income and both new style ESA and UC are classed as income. The transitional protection puts me in the higher earning bracket therefore I will need to find an extra £104 per month, on top of £91 rent per month... So while my new style ESA and UC amount to roughly the same as my income related ESA, my rent and council tax are now costing £195.00 per month. So basically the idea that a disabled person needs a little more money to live on, is clearly no longer respected, and they are trying to take it back from us ASAP, in any way that they can. I can't afford £195 per month, so therefore my home is now in jeopardy. Has anyone challenged this or is it literally the 'new rules' as my local council tax officer told me today?

It is not the " new rules " for everyone just for those in your council area.
Unfortunately you are living in a local authority where it appears they have decided to penalise disabled people by increasing their Council Tax liability. This practice varies from council to council. You need to gather more local information regarding this. Often councils publish the minutes of meetings etc or make statments regarding their Council Tax support schemes.
You may be eligible for a DHP ( discretionary housing payment ).

Slightly different situation in my case. My mum gets housing benefit and council tax support. She is retired. So they were taking about £15 off of her housing benefit as a non dependent deduction. But when i came off ESA because my savings went over the limit I assumed becuase my income has gone down it won’t make any difference to council tax support. I knew they would continue to penalise her with the housing benefit because nil income and ESA has the same non dependent deduction.
When they sent out a rent/council tax tax review form they hit her with a back payment of council tax as it turns out that me not getting ESA reduces her council tax reduction entitlement.
So I’m wondering if councils are treating council tax differently for those who are migrated from ESA to UC. Just another scam to hit the unemployed, sick and disabled and wear us down I suspect.

I'm not sure if this effects anyone, but last year, my local council made a huge error, and I have single persons discount and Council Tax support, but last year, my council told me I owed them £900 for the year and I knew it was incorrect, having worked in Finance for many years - but I decided to get a finance specialist to look at it, and they come back telling me that housing benefits had added a tariff income to my bill, rather than subtracting it. I sent a letter to the leader of the council tax dept, and received an apology letter back, and also a new bill, saying they owed me close to £200 - so maybe people want to enquire about a tariff income if they feel their award is incorrect - because my guess is, some people within local authorities, aren't actually sure what they're doing and imputting the incorrect data into the system.
