WCA ignoring evidence was created by Preferanon
My WCA completely ignored that I'm sick at least four days out of seven. How can this be so when I've comprehensively shown this to be the case? All I got back was that I was '...capable of some kind of work...'. I thought the rules were if you were ill or affected by your conditions for 4 out of 7 you would qualify for your benefit. Is this decision even legal?! On another note my employer doesn't want to give me the day off for my tribunal. What do I do so as not to get a sanction for attending if I choose to? Does an employer have to give you the day off in law and can I take it further if they don't? Many thanks.

Hi Preferanon

Contact UC and ask for a copy of the assessors report called a UC85, i would also add the request to your journal.

I have the report by the HCP. Is the U385 another form or something by another assessor for internal reasons? I need to leave no stone unturned.

The UC85 - is the assessor's report. It sounds as if you already have it.
