Hi everyone,
I am asking for a little advice, I have a few questions, hope that is ok..

A little about my claim -
I am currently on IRESA. My claim is for myself, my partner is included in my claim. My partner is an unpaid Carer for me.
I am in the Support Group. (I receive high rate PIP for both elements, not needed in this, but for ref.) My partner's only work above caring for me and running our home, is the permitted ESA work at £80 a month.

REF INFO -
We have never attempted to claim "Carers Allowance" as I was advised that it affected the "national insurance stamp" and that if we claimed "carers," this would affect my partner's state pension amount paid out at pension age. I was informed that no stamp is paid if the carer allowance is claimed. I was also told that the Carers Allowance would affect how much is paid for the claim overall. IE they would reduce my claim by the full carer amount.

REGARDING PARTNERS WORK -
My partner had one face-to-face interview many years ago when I transferred from Incapacity Benefit to IRESA.
We explained how much I needed help based on having a fluctuating condition.
We advised them that permitted work was all she could manage in between.
The DMP ESA person advised us they would not bother her again and make notes to this effect on our claim regarding this.


MY QUESTIONS -

I have a few questions related to the above, a question or two below too, to help with my form filling.
When we receive the ESA Migration letter (Not yet received).


1) Should a claim for carers be made on transfer and will that affect transitional protection with not being a paid carer already?

1A) On UC, if someone is awarded Carers Allowance, does this affect the national insurance stamp paid against pensions?

1B) If a carer allowance was awarded, who is that paid to..? Would the payment be a part of the overall claim?

1Bi) If a carer allowance was to be paid, would that be deducted from the overall claim amount, reducing said amount by the full carer allowance awarded?

1BII) If the carer allowance was to be paid, would my partner still be part of my claim? (like now on IRESA)

1BiII) Regarding ESA, I made a claim and added my partner to my claim.
Is that the case here? Am I still claiming for my partner and will be awarded an amount for her in my claim?

1C) If a carer allowance were to be claimed, would my partner be removed from the "having to look for work" categories etc.? Could she be removed from the "having to look for work" category, like in the past based on my situation anyway.?


MORE REF INFO (IN REGARDS TO Q2 ONLY) -
Questions on forms have been asked in past claims, Incapacity Benefit & Income Support, if you are self-employed.
This is not the case is this case. ESA permitted work is cash-in-hand and advised to ESA.
I am concerned about how to/where to correctly advise this, and in which section of the form.

2) Does anyone know how I address where to advise about the cash-in-hand work?



Final Question & info -
I am getting a little confused regarding the journal, advising being in the support group etc...
I read somewhere, that on claiming for UC, once you tick the box for I am receiving ESA, they look into this and once that is done they can see you are in the support group. I read you are then removed from having to need a sick note, looking for work activities etc.
I am worried about all this as I am reading so many horror stories right now regarding migrating...

3) I would be grateful for all advice on where and when I should fill this in...?

3i) Is there a specific paragraph I can copy and paste into this so-called journal.?
One possibly stating I don't need to provide fit notes or look for work etc, I am in the Support Group.


I do apologise for my lengthy essay.

You can claim Carer's Allowance at any time and it doesn't affect Transitional Protection.

1A) On UC, if someone is awarded Carers Allowance, does this affect the national insurance stamp paid against pensions?
For each week that you receive Carer’s Allowance, you get a Class 1 NI credit towards your NI record.

1B) If a carer allowance was awarded, who is that paid to..? Would the payment be a part of the overall claim?
Carers's Allowance is paid to the carer.

1Bi) If a carer allowance was to be paid, would that be deducted from the overall claim amount, reducing said amount by the full carer allowance awarded?
Carer's Allowance is an overlapping Benefit and is deducted in full from means tested Benefits.

1BII) If the carer allowance was to be paid, would my partner still be part of my claim? (like now on IRESA)
Your partner would still part of your claim.

Sorry, I don't understand your question.

With UC the claimant in receipt of the carer's element does not have to look for work.

Yes, the DWP have admitted there is an initial glitch in their IT with regards to transferring Support Group status to UC LCWRA. But if you keep in touch with BenefitsandWork you will be given assistance.

You can get advice from Citizens Advice Help to Claim and their phone number is on page 2 of your UC Managed Migration letter.

As I said before there is a glitch in the UC system which they are award of and all you need to do is say you are in the Support Group. If a badly trained Work Coach challenges this I can show you how to complain to a manager.

Tnx David for the time taken, much appreciated...

Regarding carers and your answer, the fact they deduct in full from means tested benefits and our benefits pay household bill, there would be no point claiming. I can't reduce the amount I receive by that much to pay my partner, our benefits income is already shared and pays for everything.
The only benefit is my partner would not be hassled into looking for work.. The fact in-between helping me, running the home and working a few hrs 2 weekly, it's all she's can't do. We will explain that.... Go from there ..


Regarding the ESA cash in hand permitted work. I am just unsure where you would advise this, my partner is not exactly self employed, so you can't say self employed, maybe when there will be another section for other income?

Lastly regarding Support group, if they're it's an issue and they have not ironed out a smoother transition by the time I get the letter and I need to complain, I will take you up on your help, advise, that is definitely appreciated. ..

Hi PaulC,

You should get advice regarding whether the work is self employed. As apart from Benefits it could affect other things such as car insurance and HMRC tax.
If you need to complain about the Jobcentre I can find the details of the local managers.
