This has probably been brought up so many times but on the 20/11/24 I attended my PIP appeal at the magistrate’s court.
Since April my higher rate mobility rate was stopped. I had previously scored 12 points then marked down to 2.
I was obviously upset (that’s putting it lightly) but I persevered and followed every procedure to the point of awaiting my date.
I sent all medical proof well ahead of time and even a letter of support from my GP.
I have significant medical conditions:
This includes hemiplegic migraines to which the latest admission was because I was unconscious. Overlapping this I functioned neurological disorder which in the first instance a stroke has to be ruled out. This then means I have physio, occupational health and speech and language input and now accepted aids around the house as recovery is slow.
I have a colostomy due to a perforation from an ERCP which has now left me more prone to biliary sepsis and jaundice which again causes acute episodes of severe upper abdominal pain which now carries a mortality rate of 20%. I have developed severe anxiety if told I’m being admitted and honestly thought this would be substantial as I already stated in my impact statement and basically a full ream of paperwork as my history goes on. I really struggle but I work when I can as I have to.
I was taken into court sat down told to put the loop on . The panel of 3 were introduced then basically the judge sat there saying that the hearing would be adjourned because my evidence was illegible and pages were missing only because I was saving paper and all it contained was the medication on discharge which never changed but she made out that I could be hiding evidence or something I didn’t want them to see
I got totally stressed after being told I would now have 21 days to get the information from my GP (as if they don’t have enough to do?) They saw me basically break down and not an ounce of care or compassion was shown. I had to get someone to take me as I get stressed with unfamiliar places and it cost me a day annual leave. I am absolutely exhausted. Please tell me this is normal?

I am so sorry to hear of your unpleasant experience. At the end of your post, you ask, "Is this normal?".

Unfortunately, although not common, your experience of a lack of compassion when you broke down is certainly not the first time this has happened. It is clearly upsetting to you and anyone that it happens to.

Regarding the information you submitted, I can understand your frustration at having to produce further evidence, but if Tribunals don't have the evidence or can't understand what has been submitted, they will postpone the Tribunal and give the claimant the chance to resubmit.

I know this seems hard from your point of view because you missed out on unchanged information (e.g., medication). Unfortunately, if they can see there are missing pages and don't know why, they will assume that a claimant may be deliberately hiding information (because some people do). It's hard on you and a lot of extra work, but I'm afraid you will have to do what they ask if you want them to consider your evidence.

I hope that you can access the information you need from your GP.
