Hi all About 3 years ago just after l started on UC I was 60 and could take or defer my Royal Navy and Local Government pension I thought that it was taxed at source so it wouldn’t affect my UC. When I had a Financial review, I was told it will be stopped out of my UC and I would need to pay back the 3years worth of payments I had received back to DWP. I asked for a MR on the grounds that if I had known I would be stopped the pension amount out of my UC I would have deferred it. The MR upheld the DWP decision. I understand I made a mistake but I still think it’s harsh to have wasted 3 years worth of my hard earned pension. I am now being stopped my pension amount plus paying back another £96 per month. I was wondering if I should appeal as I have heard DWP sometimes will make a concession On amounts to be paid back. I am now on LCWRA and PIP my health has worsened And I can’t work anymore. I simply would not have taken my pension for It to be completely taken off me and wasted. It makes no sense and surely there should be some leniency. Regards PG

Hi PG,

Leniency is one thing that the Tory government at the time did not want included in Benefits legislation. UC was designed to simplify and reduce Benefits generally. Hence where before if an overpayment was caused by official error the claimant on Legacy Benefits could apply to keep the payment, this was explicitly ruled out in UC. Furthermore if the UC claimant is late in reporting a change of circumstances the government has introduced fines called Civil Penalties.
You say you had a Financial Review. Was this a UC Enhanced review or a DWP Compliance Team review?

I’m pretty sure It was just a standard review as not had one for 3 years
