I’m on legacy benefits ESA income and Housing Benefit while also being on PIP.
I’ve received the Migration Letter and been reading up on the migration process and am aware that I should get transitional protection.
However at the same time as all of this - they are reviewing my PIP award and I have a feeling they are about to try and take away my PIP award before I transition over. I will of course appeal their PIP decision if they lower it or take It away.
But my question is, let’s say I’m forced to migrate from ESA to UC, at the same time as they take away my PIP, will transitional protection come into effect if my PIP is taken away and then later backdated and successful ??
Or is this some loophole they are using to remove my transitional protection before I switch??
The administration of PIP and Universal Credit are completely separate and while medical information can be shared there is no collaboration between the separate departments. So it would be just a co-incidence if you failed a PIP assessment during UC Managed Migration. Of course it would be still within your rights to ask for a Mandatory Reconsideration. Your Transitional Protection once granted would not be affected by PIP and can be backdated if a MR or Appeal is successful.
