Pip, mobility 11e and 11f was created by angiegood
Hi, Please can someone give me advice.
My son has mental health, ADHD, dyslexia and dyspraxia.
I am in the middle of an appeal for his review for PIP mobility.
He has been awarded 10 points, 11e for OPD.
I have been trying to get them to change to 11f.
They have written " A claiment who satifies 11e cannot also satisfy 11f. If they cannot a single journey on the majority of days due to OPD, then 11e will be the applicable descriptor, even if there are occasions when he could follow a familiar route , if accompanied ".
I am confused
I did explain, many times because of his ADHD, dyslexia and dyspraxia, he cannot plan and follow a journey.
He has problems with memory, planning etc.
What am I doing wrong.
Thanks.

Hi angiegood,
Please see the response I made to a recent post with a related query.

Mobility descriptor 1 is incremental or cumulative this is unlike some descriptors where you might be able to fulfil all of the subset of activity tasks. So, you will only be able to achieve points under 1f when you can show that you can't do the previous level of tasks in this descriptor.
DWP are somewhat correct-
As I clarified in the post I linked, there is a justification that people who can't go out, or seldom go out due to sheer anxiety don't need as much support as those who need some one with them. Anyway that's the theory!
If I understand what DWP have decided, they are saying they believe your son has OPD, and therefore can not undertake any journey ( for the majority of days and 'reliably ' - reliably is the shorthand for the 4 criteria which comprise safety, time, repetition etc). And it seems DWP have accepted there may be a few occasions when your son can go out on a familiar journey if with someone.
This part is potentially correct.
You can't score more than one level in the set but if there is a conflict, then the score with the highest value should be awarded when 2 or more activities within one descriptor set apply equally.
Maybe you should consider thinking exactly why your son needs to be accompanied when going out. What happens, what does he do or need. What goes wrong. Give examples.
The need for beingcaccompanied can be for any reason, including OPD.(DWP argued this issue in a leading case and attempted to change the descriptor wording to say ..other than via OPD for 1f - but this was held o be unlawful by the High Court! DWP often try and maintain their view of the law is correct and/or haven't bothered to inform all their staff!)
Let us know if you need any more specific information.
I hope this helps.
