Migrating from ESA to UC - what will the LA take? was created by Cassie
I am appointee for our adult son who lives in Residential Care. At the moment, the County Council take back all of his ESA when working out his contribution towards his care. Will this be the same when he migrates to UC? Is it treated exactly the same? I’m waiting to hear for definite how much his UC will be, but from what CAB advised it will be a bit more. Thanks so much for any help.

We cannot give you an answer as it would depend on the policy of your local County Council,
We cannot say for certain how much his UC will be as we do not have all the facts. I would assume that he would stay on HB as he is in supported accommodation, I assume that he is in the support group of ESA from your post, in which case if your son is over 25 he would get UC SSA £400.14 + LCWRA £423.27 = £823.41pm.
Most ESA support claimants who do not receive any disability premiums with their ESA will be better off claiming UC.

Thanks so much, I will contact the Council once we have clarification of the UC amount. As he’s in Residential Care, he doesn’t get HB.
