I don't want to go to the ESA medical was created by Melanie
Hi everyone, it's been a while since I've been on here, so hello again!

I was placed in the support group for ESA after appealling. However, I did not know that there was a time limit to being in the Support Group, so imagine my dismay when I got the forms and everything back through the post.

Because my medical was a horrible experience, I don't want to go to the medical. Obviously I will go, but I am trying not to have to.

I wrote a letter to Atos explaining the fact that I fit one of the descriptors and therefore should not have to attend a medical. I sent all my evidence with the questionnaire special delivery. Part of the evidence was a letter from my GP explaining that walking 20 metres is difficult.

I also sent the same letter addressed to the Jobcentre plus explaining that legally I shouldn't have to go to a medical. They replied saying the following:

"We confirm receipt of your letter dated 24 Feb.. and thought it would be prudent to forward a copy of this letter to ATOS healthcare.

I spoke to a representative from ATOS yesterday and can inform you that your case is presently at pre board checking prior to a decision being made as to whether an appointment for a medical is required. For your information, the gentleman at ATOS also confirmed receipt of the ESA50 along with the additional medical evidence you have provided."

Has anyone else had a letter like this? I really hope they decide in my favour.

  			 				Hi Mel,

I haven't heard of anyone getting a similar letter.

We'll keep our fingers crossed that you remain in the support group without having to attend a medical. Do let us know what happens.

Good luck,

Steve

Thanks Steve. I will keep you informed. After all, the only reason I know anything about the descriptors is due to your excellent resources.

Kind Regards,

Mel

  			 				Hi,
If it is of any help, I was granted a home visit by ATOS. I suffer from social anxiety disorder which means I am not able to leave the house. Your problem would merit a home visit.
This definitely made things much easier than visiting your local ATOS centre.

  			 				Hi!!

Great News!!! I've been put into the support group without having to go to a medical! I got the letter today confirming it.

Thank you so much for the guides and the information on the descriptors for ESA because without those I would not have known my rights.

When ATOS say don't send evidence with the questionnaire, I would say to ignore that if you qualify for the support group. Send all the evidence you have with the ESA50 and then send a letter explaining the fact that you know the law and then state the reason you should be in the support group and link it in with the evidence you've submitted. And send it special delivery! Then inform the job centre too that you should be in the support group.

Obviously everyone's situation is different but if you know you should be in the support group then push for it because the medical will really just exacerbate your condition.

Thank you Benefits and Work for all your help! ESA down, DLA to go.....
