Overpayment

Overpayment was created by sharon
Have received a letter from debt management saying that I was overpaid £211.40p incomesupport for a certain date.
It states that the overpayment occurred because there was a change in my circumstances and the office that paid my benefit was not told at the correct time.
I phoned them up and they said it is to do with SDP .
I was receiving SDP and my son put in a claim for C/A
to care for me.
He applied on line ,I was not aware you could not receive SDP and someone claim C/A at the same time.
Benefits are saying I should have notified them of the change.

The information you have received is correct.

In accordance with section 71 of the Social Security Administration Act 1992, a claimant is under obligation to report changes of circumstances as soon as possible, which includes where a new benefit/allowance is awarded.
This duty still applies even if the DWP were already aware of the change.

As CA was in payment, ie the new benefit which superseded SDP payable with IS, an overpayment has occurred which may be recoverable from you? However, as you will already be aware, you do have the right of appeal against any alleged overpayment decision.
