Will I be stitched up because I cannot remember

I was looking around the net and at info sent with my appointment and found somewhere yesterday,I think, that said the claimant is the one that has to answer the questions asked by the HCP which I believe relate to your condition and what has been put on the forms that were filled in, as well as other things, as my daughters filled them in and I signed them before they were filled in, to me it made no difference as I wouldn't remember a word that was written, due to my lousy memory, I very much doubt they copied the completed forms.
I know my daughters know more about my conditions and problems related to it than I do as they have found most of the info I have and what I have suspected was related to the main condition the info given to me mentions all the other conditions as being related with my main condition, things like concentration, memory, muscle weakness, & speech, all of which I have problems with.

I now hate to speak as I find it tiring and a lot of the time cannot even start a sentence, the speech problem started after the forms had been sent in and as I don't use the phone unless it is a number I know. ATOS will be informed when I get to the interrogation with the HCP

How do you corroborate what is on the forms when when you have no record of what is on them and you cannot even remember what you said just a minute ago.

If I printed off the info on my main condition and the things associated with it (from an American site) would this be passed to the DWP by ATOS, or just disposed of it when I leave.

If another person can speak for you at a tribunal then why not at the interrogation if they know all about your condition(s), how they affect you, and what you do during the time they are not there, because that is where they find me when they come down, in bed, only getting up to get some juice to take tablets and not at the required time of day, just when I am awake and remember.

I cannot remember if I have asked this before but, can the interrogator put their interpretation of your answer down, and not exactly what you said? E.G. could the HCP alter someone saying they took 90 minutes approx to wash up a couple of plates, knives, & cups from breakfast, because they had to stop because they became tired and ached and would fall asleep when they sat down. would the HCP be allowed to change that to just CAN DO THE WASHING UP?

It is invariably the case that with both medical assessments (either PCA or ESA) and appeal tribunals, any questions are directed towards the claimant/appellant. Different rules may apply where the person is a minor, or unable to manage their own affairs because of their medical condition..

As is increasingly common as demonstrated frequently within this forum, there have been numerous complaints about disability analysts writing things down in reports that bear no resemblance to what the person has actually said. If a person feels aggrieved at becoming a victim of this practice, there are formal complaint procedures that can be followed, if you wish to protest to the relevant authority.

This is from ATOS Guide for EMPs found in the guides section
As an experienced medical practitioner you will be well aware that some individuals find it difficult to express their problems in a clear and concise manner. Your role therefore is to help the claimant give as complete an account as possible of the help that the claimant/carer feels is needed. As the claimant may find it difficult to put this into words a patient relaxed attitude by the EMP is important.
See the carer or relative alone for a separate statement if possible, to discuss facts that may not be known to the claimant, or are too embarrassing for the claimant to disclose. Also, this makes it possible to correct false impressions given by the claimant who may be confused as to the actual amount of help needed. Those with disability due to a mental impairment may not be clear of their actual care and mobility needs…. (not much chance of that happening, but it does show that they are advised to take others views into account) … AdamAnt

Hi I am aware that you have used info from
a american site. It is possible the D M at
DWP will not use that info it may be best
if you search on dwp site a to Z of illness
and find out about your condition it will
also confirm if your illness is reconised
by dwp. you must use all your means at this
stage i sujest you go on our web site and
go through your claim from start to finish
you should know that a lot of the people
who deal with your claim are not medical
ie the only ones are the AToS doctors if
you get your gp on your side and he or she
will do a medical report sorry but in most
cases you have to pay a fee but it could
be worth it. as for your lack of memorey
you will find thats why they allow your
carer or member of your family.please dont
worry keep your head up you have help on
the web site and dont take it personel
remember they have thousands of cases to
deal with. best wishes mike

Steve did an article on medical examinations and statements which may help
Training and Guidance in Statement Taking, Gathering, and Recording Information.. On rare occasions, a claimant may ask you to accept a pre-prepared signed statement. You should proceed according to the claimant’s wishes in this regard. You should attach their statement to the report, and, ascertain whether they wish this statement to stand in place of, or in addition to, the usual statement that is recorded by the examining doctor.
Alternatively if this is now not allowed, there are forms in the DLA section that the HCP uses on visits which you could use to prepare your answers and also use as prompts for your poor memory. AdamAnt
