Hi there Help!!
I have managed to get an employer to take me on as a p/t receptionist starting next week. Phoned my GP as I had a current sick note- to ask her to sign me fit for work. I was told that as DWP had sent then a copy of FIT FOR WORK decision (no points),which I am appealing and now my GP wont sign me fit for work because she says the last 2 sick notes she issued should nt have been because of ATOS decision !!!I am afraid I got a little cross at this point as I dont see how you can issue sick notes(which I have been ESA paid for) and then attempt to rescind them! Where does this leave me with my potential employer? And will this period be classed as overpaid? Does not bode well for Tribunal if my GP is going to be dictated to by ATOS.Any suggestions would be very welcome as this is really stressing me out! I was really excited to get a job after 2 years and now this!!Thanks for listening jan

Hi Janice,
Sorry, I'm not quite sure what your GP is saying. As far as sick notes and your ESA go, there is no facility for a GP to retrospectively change their mind based on what Atos have decided, so I don't think you need to worry about overpayments. You met the requirements for the assessment phase of ESA and were entitled to the payments you received.
But are you saying your GP is now refusing to say that you can safely start work again?

no- Gp is saying that as DWP temporarily disallowed me from 12/03/2010 as a result of Atos Report she will only issue me a fit for work note saying that I am fit for work from 12/03/2010(THE DATE OF DISALLOWANCE) not fit for work from 31/05/2010 as I requested as I am starting work on 01/06/2010!!Its great that there wont be an overpayment but how do I get the return to work date amended to 31/05/2010?Do I actually need them to sign me back or can I just start work anyway?. Dont think she is being malicious I just think she is intimidated by Atos Report and just does not understand the return to work procedure. Should I just accept the note she wants to give me stating the 12/03/2010 or should I query with Local PCT? (I think what she is saying is that the sick notes should not have been issued because of Atos Report so she wont even sign me back to work!)I can safely start work because the condition I have is permanent.
I hope that makes sense, I was absolutely furious when I typed the query last night so please make allowances for anything that was unclear.
