uni degrees needed to wrok out how dla works

I uterly dont understand how they work out rates. I have been told to ask for a supersession on mine and I am to darn scared to rock the boat as I get middle rate care low mobility indefinantely though my care needs are more than when I was awarded indefinant.

My husband has 2 types of arthritus and is diabetic and we cant get hin any higher than low rate care though we are going to go for a suppersion once we have the latest hospital scan results and our doctor has agreed to support an increase and says he has ground.

An advocacy work recently told us it was down to budget and stats which we knew anyway and that they will try not to increase my husband because if they give him middle rate care it will not just mean that it will mean our sick will go up care premiums and so on costin them more. My brother in law has far less wrong with him than my husband and does not need the same help as my husband yet gets middle rate care.

My 2nd son unfortuately had developed some mental health problems and because of a attempted sucicide attempt at 10 pm at night they have given him low rate mobility and high rate care which we were stunned at and my son was sheepish at as he said that whilst he is grateful for the additional(and it certainly means we arent having to subsidise him) he says he feels guilty because his step dad my husband and me should be getting more.My original claim for dla was done on mental health grounds 12 years ago and my rates have never gone up even though I need more help than then as I also have physical problems today including a stomach and bowel condition fibromylaga and threads of and yet dla relooked at my case twicw ith these symptons on before they awarded indefinantely.

I am just making observations that their seems to be no balance in the system and budgets and stats do come into play and wondered if others have found this.

I am contacting the condems and IDS over his position to simplify the welfare state and where that is going to leave us and whilst it may not make much difference I want my say on this

DLA is based on needs and not the names of diagnosis.

The criteria for an award of DLA care and/or mobility component is clearly set down in law in Social Security Contributions and Benefits Act 1992 Sections 72 and 73 and in The Social Security (Disability Living Allowance) Regulations 1991 parts III and IV.
