what dya do re medical failure with medical proof

ok need some sound advice here.

was called for atos medical, took medical proof re mri scans, xrays consultant notes.

was kept waiting 1hr to the point collapsed after 15mins due to pain. someone found a bed to lie on until atos dr arrived.

claim is re crumbling spine unable to sit walk stand, can only lie to releive pain, have to crawl to toilet. only stand for 2 mins to get access to alpen bars cook soup, then end up falling to floor in agony again.

also have gall bladder issues resulting in pain in abdomen so severe after food can only eat every 2 days so i get some releif from pain.when eating again pain so bad and followed with diaorea. back issues and having to crawl means often dont get to toilet in time, you can imagine the rest re poop.

job centre phoned saying had failed medical and had to attend work interview, told them cant too much pain cant evenget from bedroom to open front door, had to be taken to atos medical in wheelchair. they said work interview would be deferred, asked what that meant, told no jsa as unable to attend work interview and incapacity stopping as medical failed. basically told - no money for me.

i want to know what to do next,had all proof of crumbling spine, mri xrays, proof of gall bladder and toilet issues, was in so much pain collapsed at reception after trying to ease pain by sitting in wheelchair, standing, until so bad had to be found a bed to lie on.

what are these atos dr's doing when someone in my condition turns ups like this, with proof and in agony,that they write back to job centre saying failed medical ?

how do i fight this when in too much pain. people mention appealing, i cannot go through all that apin again to leave the house - is there a wayof getting someone to go as a representative,is there any legal help to overturn this blatant denyal of evidence that i am ill?

please help, the pain i am in is so bad,option of having my life flash before my eyes is looking far better, at least the pain will end. i am coping only because my son orders food on the internet from uni and comes back every 2 weeks to be here for the delivery, its messing his course up but thats how we cope.i am alone and cant get to my gp as in too much pain,gp writes sick note which i have sent to job centre for incapacity, but now i am told this money will stop even with a 4 week sick note as a result of failed atos medical.

sorry to go on, but i have no idea what i do now, i am too ill and in so much pain and having bad toilet issues I cant help myself anymore especially re another medical,i endured agony.

The only option is for you to appeal the IB adverse decision.

You could try and enlist the help of a representative, but the obvious problem that may arise would be that the representative would strongly recommend that you attend the tribunal with him/her. If you were unable/unwilling to attend the tribunal, the panel members would be denied the opportunity to question you directly, so the representative would more than likely decline to attend the hearing unaccompanied. Non-attendance by the appellant would render the hearing no better than a paper hearing, and the chances of success would be relatively low.

As you have a current medical certificate, the only circumstances whereby you could reclaim IB, would be if your condition had deteriorated or you have a new medical condition. It would be for your GP to confirm that either or both of these conditions exist, otherwise you will have to wait twenty six weeks before you can reclaim IB.
