Hi, first I would like to thank the Benefits & Work site for all the valuable information I received to complete my ESA & DLA applications, and would like to share good news.
After having an medical examination I was deemed fit enough to work. I challenged the ATOS Dr's competency as the report did not reflect my difficulties experienced on a daily basis, and did not take into consideration the medical reports documenting my disability ( I was recently ill health retired). After a lengthy challenge, and successful tribunal, I am now in receipt of ESA & DLA, and was placed in the support group. Both the tribunal judge and doctor stated that they were very sympathetic towards my appeal, and agreed that the content of the ATOS report was indeed poor, and did not reflect what I had stated in my ESA form or the evidence provided by the consultants I am under.
Today in response to my complaint and request for a quality audit, I received a letter from ATOS acknowledging the short comings of the Dr's report and an apology!
I found the whole experience very exhausting and distressing, but glad that this doctors competency to conduct examinations is now being investigated.

Congratulations Compactgirl. I haven’t heard of anyone who’s won an appeal and got an apology from ATOS as well. Well done.

Hopefully *they* will see now that ATOS is costing them money due to all the appeals. Wondered how long it would take them before the penny finally clanged to the bottom.
