when you win a tribunal do the dwp have to pay you the IB payments that you should've been getting less the reduced rate income support you were getting while waiting for a tribunal. any response would be greatly appreciated thanks!

When you win a tribunal, your benefits are backdated to when you made your claim, taking into account benefits you have received. There are special rules in relation to capital limits if it's a lot of money, giving you extra time to spend it before it affects any future means-tested benefits.

Does anyone know how long the dwp take to give out back payments and start paying you the normal incapacity benefit rate after you have won an tribunal appeal, I won my appeal on15th march and got my benefits today for the first time since expecting to have the normal incapacity benefit rate back but still only got paid income support at reduced rate.any advice would be brilliant thanks!

Hi Chew. I won my appeal towards the end of January and both myself and the DWP were written to that day.

I waited 6 weeks and then my ESA stopped. The DWP had not put on record that I had won my appeal.

If I were you, I would phone them and tell them that you have won.

And send the DWP a copy of the decision notice. They probably lost theirs!

Thanks Chew for asking this question - and for the replies. I won my appeal on March 11th and was wondering when I should expect any response from the DWP.
Will be photocopying my tribunal notice today!
