even looking at regulations for example here
Regulation 35 allows for claimants receiving certain types of chemotherapy to be treated as having LCWRA
thats not clear as to which type of Chemo ? so even cancer and cancer treatment is open to question
yet someone who will get chemo but does not know which type yet, but will get treatment in next 6 months will get in support group
info taken from here
ssac.independent.gov.uk/pdf/esa-amendment-regulations-2011.pdf

The lnk is 2008 and therefore may no longer be in date, however it refers to Dave's q's on chemo

Not being flippant, but I did follow the guide, I have had extensive surgeries on one of my shoulders and it is now completely usless (as eveidenced by a surgeons report from couple months ago) my other shoulder is riddled by arthritis again evidenced, also I had to have a wheelchair for 3 months and it was impossible for me to get around without help again evidenced. all covered by letters from various health proffesionals. Thats only one of the descriptors I should have got in with thanks for the guide help as well .
Hi C,
I'm glad to hear that you are aware of the mobilising descriptor, not only pertaining to walking.
There are still quite a lot of claimants who are not aware of this, so just thought I'd point it out.
I'm sorry to hear that you feel that you have not been given the correct assessment.
It just goes to show that even if a claimant fills in the ESA50 with extensive detail, and provides extra medical evidence, that there is still no guarantee that a correct award of ESA will be given.
However I feel that if a claimant just simply fills in the ESA50, only giving sparse detail, the chances of a correct assessment are diminished.
If you are appealing, draw attention to all the evidence you have provided, and how it pertains to the relevant descriptors etc.
As you will automatically receive a reconsideration on appealing, and your file will be looked at by a different DM, you may then be placed in the correct group.
I am sending a 97 page file including my ESA50, however I am not banking on anything. I just know that by doing this, it will make my fight easier, if I don't receive a correct assessment.
Best wishes

the problem that i had when filling in esa50 was the fact that i had to use my doctors information alone as all the specialists info i have is over 9 years old and i was told by atos that this would be of no use because of the age of documents, i was told by surgeons and specialists that there was nothing else to be done for me. i was suposed to have medical on the 7/9 but it was cancelled, so now bricking it all over again. i just havnt got any up to date info just doctors
