I realise that IIDB is not really covered here, but I thought the following may be of interest. 12 months ago, my daughter underwent an ATOS examination and was given 15% less 5% for an 'existing condition. She was therefore turned down for the Industrial Injuries benefit.The ATOS exam was to say the least, a farce. He even reported that he could not assess certain aspects of the disability because my daughter was unable to use her arm and hand (these being the reason for the disability)! We wrote and appealled only to be turned down yet again by the jobsworth at the DWP. We requested that the matter went to a tribunal and three weeks ago, she faced two 'judges' regarding the matter. The outcome of this was that they overturned the decision giving her 33% less 3% and backdated it to last year.
Just shows that if you are genuine, do not let them get away with it. Good luck to everyone.
I'm glad that you have got the right decision. However, I am a little concerned at your assurance that 'genuine' claimants will be OK as other peoples' stories do not always bear this out!
