None of the changes related to the IB to ESA transfer have affected the underlying IB legislation, with the exception of the IB linking Rules and IB assessments, so if this was valid under IB then I would assume that it still is.
Without intending to disuade anybody from attempting Permitted Work, I would point out the following;
- The rules for Permitted Work under ESA are different from those under IB.
- Only a DWP Decision Maker can decide that the work being considered meets the Permitted Work rules.
- Starting Permitted Work used to be an assessment trigger for IB, as IB medicals are no longer taking place, this may cause an early transfer to ESA.
- The ATOS "doctor" will be aware that you are carrying out Permitted Work and will factor this into any assessment.

The Permitted Work rules
Under the Permitted Work rules you can:
•work for less than 16 hours a week on average, with earnings up to £97.50 a week for 52 weeks
•work for less than 16 hours a week, on average, and earn up to £97.50 a week for as long as your illness or disability is considered so severe that you are meeting the threshold of incapacity without having a medical assessment
•work and earn up to £20 a week, at any time, for as long as you are receiving Incapacity Benefit
•do Supported Permitted Work and earn up to £97.50 a week for as long as you are receiving Incapacity Benefit
