Mel, please, please, please be aware that they are also passing regulation to get overpayments back.

OMG OMG Have I been overpaid then? I have been in receipt of ESA since September 2010, so does this mean that if the bill becomes law in April, they will deduct 365 days from what I have received, and then ask me for the rest back? Our money is paying off our overdraft, not sitting in the bank. I am really worried now.

You are fine until the day that the Bill is passed!
Sorry, didn't mean to worry you.
It is only if you have had 365 days when the Bill is passed.....probably in April.
If you receive any payments after that day, they will likely ask for them back.

I am so sorry to have worried you.
You wont have to pay anything back that is paid to you before the Bill is passed.
If you have had 365 days when the Bill is passed, any money paid after that day will probably be recovered.

There is no need for you to worry, whilst the time limit for ESA(CB) is 365 days, it only applies retrospectively in the context of your ongoing entitlement.OMG OMG Have I been overpaid then? So there will be no requirement for you to pay any money back just because you will have been in the WRAG for more than 365 days.
It just means means that your ESA(CB) will cease on 6 April 2012.
