just wondering how long it takes for an appeal for ESA to get sorted my IB payments run out on the 7th Nov i assume i will get the appeal rate of ESA until its decided but im distressed that i will be losing £25 a week during this time an amount that i can not live on if i win my case i know it will be back dated but thats not the point

Sadly it is not possible to predict how long it will take for a particular case to get to a tribunal hearing.
The latest government information (for August 2011) showed an average of almost 8 months from GL24 appeal form submitted to tribunal hearing across the UK but there are possibly local variations either way.
If the decision made found you fit to work, then yes you will drop onto assessment rate pending the tribunal.
If the decision was to place you in the WRAG and you are appealing to get into the Support Group, then you will be paid at the WRAG rate pending the appeal tribunal.

It took exactly 1 year to get from submitting my appeal to be called to the tribunal.
The tribunal hearing was NOT as daunting as I feared & it was the first time that 2 real independent professionals, (Judge & Doctor) had assessed ALL the evidence that had been available for months & months.
The appeal was prompt & quick & although I was very, very anxious, it was not threatening in my experience.
The decision from the tribunal took just a few minutes.

You need to speak to your local CAB or Welfare Rights office, to see whether you qualify for any other assistance.thanks for replys is there a top up benefit i could apply for then for the 8 months to a year wait im seriously concerned about how im going to survive on assesment rate until its sorted
If you received an Income Support top up with your IB, then you may be eligible for other benefits such Housing Benefit and Assistance in paying your Council TAx.
