IT TOOK 8 MONTHS to get to appeal.Do l have to repay the esa benefits lve recieved whilst waiting for my appeal? MY HEAD IS HURTING !Cant decide whether to turn to chocolate /drink to mke me feel better!
No, you do not have to repay any of the payments you received while waiting for a the Tribunal hearing.
As it is now more than six months since the original Decision, you can make a new claim for ESA.

Sorry to hear this. It's something that I am dreading. I know my nervous system will be shot and I will be in a real state. I think it's so wrong that we are being treated like this. Yes complain to everyone you can. You have to. Good luck

I am sorry to hear you were treated like this. I have been to appeal twice and have to be honest they were were fine with me, polite but not over friendly, nothing that would have given me reason to complain so it is really sad it is not like this for everyone.
At my last appeal there was a delay, hearing before mine ran over and then to add to it my rep didn't turn up, I got so upset at thought hearing wouldn't take place but all the staff were so helpful and gave my dad and sister support in getting me calmed down, getting me a drink, giving us access to a phone etc....
Hope you feel calmer about things soon.

why is the onus ALWAYS on the claimant
to expend never-ending energy, time
and expense on such an obvious mistreatment. I suppose they're a law unto themselves, tribunal staff, with no monitoring from independent bodies
