Hi, I’ve just got a question about Jobseekers Allowance (JSA) for someone who is receiving an occupational pension.
As I stated in my first post, I received nil points in my ESA medical assessment and have been told I will have to apply for JSA. I will be appealing against the decision but knowing JSA is means-tested does the occupational pension I am receiving mean I am ineligible for JSA? For information, I worked, and therefore paid NI, for 23 years and my net occupational pension is around £300 per month.
We don't advise on JSA, only incapacity and disability benefits such as ESA or DLA.
However, if you are appealing, you should be paid the ESA Assessment rate while you are waiting for your hearing to be heard, this should be at the same rate as JSA.
If you are receiving Income Related ESA then your pension will be deducted £1 for £1 from your payments. If you are receiving Contribution Based ESA then any pension income in excess of £85/week will deducted at the rate of £1 for every £2 of pension.
