Still no ESA 85 report

Hi, I requested ESA85 & ESA85a after medical .

I put a request in writing to DWP for these & all paperwork over a week ago.

Put in wrag but no explanation, prognosis or timescale.

I still have not heard anything.

Is this a common problem.

Hi,

Unless you asked for these documents as part of a formal 'Subject Access Request' under the Data Protection Act (to which strict time limits apply) then there is generally no specific time for receipt of the documents you have requested.

It can take a while for the DWP to retrieve them from the repository where files are held., so a week is pushing it rather.

However if you are considering an appeal or reconsideration, do not delay these actions pending receipt of the documents as it can be difficult to obtain a late appeal/recon.

Mine took almost 4 weeks to arrive! thought they'd forgotten or lost it. (I wanted one for the prognosis/potential timescale for reviewing so didnt need it for an appeal or anything).

If you phone for the documents and state that you are appealing they may treat the request as urgent, or at least they did with me and sent them in a few days. However there is still no guarantee that this will happen and it's worth following up with a letter.

Neil, I got mine 4 weeks later. I had to write to them 4 times. In the 4th occasion I sent the letter by recorded delivery and in the letter I said if they didn't send it this time I would make a SAR. I received it 2 days later (1st class) with an apology!!!

Hi mumsgirl, i sent letter 2 weeks ago, no response rang up last week. Told that i was entitled to esa 85 and that the person woukld send email to the relevant department that deals with this.

A week later no report, my time runs out to appeal wrag to support on Monday.

I am disgusted without the report what grounds can i appeal. I think they have done this so my time to appeal runs out.

Also i usually get my fortnightly payment today. No money has gone in, anyone had this problem since been tranferred from IB to Wrag.
