Nurse at ESA incorrect findings

I decided to appeal the decision to put me into the WRAG group as I think I should be in the support group for ESA. I requested a copy of my medical including the page(s) detailing points given. I have so far received the nurses report and couldn't believe my eyes. I did not manage to do any of the exercises as I was in so much pain yet the report gives opinion on how far I can move my hips, knees, ankles and feet-none of this was examined so I cannot see how he could possibly get this information and give an opinion on it. A lot of the comments are the same as last year it is as if they have used last years medical report, the only difference being last year the DR thought I could return to work in 3 months maybe less, the latest medical advises a return to work could be considered within 12 months.The stress of this is starting to get to me but I will carry on with my appeals as I am sick and tired of them trivialising my conditions.

Hi Fibrofog, I was in the same position as you 2 months ago, I went for my esa medical on the 8/9/11 and I also got a copy of my medical report and it was the same as yours, the nurse had put on the form that I refused to get onto the couch and refused to touch my toes (which i cannot do anyway) I made a complaint to Atos verbally by telephone and they sent me a complaint form to fill in. I got a response back and another dr had to re-write my report as she could not understand some of the mis-spelling and they even admitted that she had filled the report in wrong. So give Atos a ring and when you get your results back from esa you could telephone them and tell them you are complaining about the nurse from Atos. I ended up appealing as i was put in the wrag group and my appeal was reconsidered and I was put in the support group within 6 weeks after putting the complaint into Atos as they send a letter to esa to advise of the outcome of your complaint.

Thanks for that will do, need to call them for the points section of forms. I did this last year and have yet to receive them-won't be waiting too long this time before I chase them up. Glad you got it sorted. Looking through last years report and comparing them almost exact except length of time it was advised a return to work could be considered in. Will post any progress I have.
