Wish i found this site sooner.

IB/ESA I filled in ESA50 and was put in WRAG, I feel i should be in Support Group,so i wrote to them and asked if they would reconsider I got letter back telling me they have looked but no it cant be changed, they also sent me out ESA50A with very little detail on it,
I phoned them for a Statement of Reason. They said i should get this in 3/4 days that was 8days ago, phoned again today they said it was sent out 24th November.
Should i wait a few more days, or just send in a brief Appeal as time is running out.? Thanks Michael.

The important thing is to lodge your appeal within the one month allowed, as a late appeal request are only rarely accepted and yo would need to show good cause for the delay.

If you wish to appeal ensure that you do so by the deadline, you can state that you are awaiting the information that you have requested, and will submit further evidence when you receive it.

The DWP are required to carry out a Reconsideration as part of the appeal process, so there is still an opportunity for you get the Decision overturned, earlier rather than later.Hi again I'm just about to send in appeal.

However, there is probably only a four week window for you to submit additional evidence and/or a clarrification of your disabilities, they may wait longer as you are waiting on a SAR, so get that in as quickly as possible and if you have to wait for it, send a regular update to the Decision Maker so that they are aware you are still waiting.
