I have been told that I will be placed into the wrag group after sending my esa50 form back using the guide lines given here. I have been disabled for over 20 years following an industrial accident and have been for many medicals for the DWP yet on this occasion I have not been requested to go for any medicals I have always passed medicals in the past, I have also discovered that no one has requested any medical records from my GP how can anyone make an informed decision regarding my disability solely based on information in the ESA50? I am about to make an appeal using the helpful guides on this site should I mention the fact about my medical records or hold back until I go to the appeal.

Hi

If appealing a decision of ESA, you should supply all the information in advance of your appeal hearing. If you leave it too late, it might be disregarded.

same thing happened to me, and many others transferred from IB. I made it quite clear on my appeal form that they should have checked my medical records, I actually requested they do so on my ESA50. still waiting to hear whether the decision will be changed at reconsideration or they are sending my appeal to the tribunal service. just coming up to 14 weeks since they recieved my appeal form :blink:

Thank you. You're most welcome.

The benefits system is most confusing and complicated. I quite understand how daunting you find it in dealing with an appeal. Hopefully the B&W guides, will assist you with this, but please feel free to ask for help at any time. The Moderators will do their best to assist.

Hi jlt,

You could enquire whether they issued a ESA113 to your G.P. if not, why not?

See ESA113, here :

If you are to appeal, you will receive an automatic reconsideration, therefore it would be advisable to submit all relevant evidence that you have at this early stage.

It is possible that the decision can be changed at this stage, therefore negating the scenario of a lengthy wait for an appeal hearing.
