hi i failed my medical in october, didnt receive my letter until 25 of november telling me i got 0 points and my money stopped from the 14th of november, my husband made a fresh claim for job seekers allowance on the 25 of november, we have had no money for nearly a month, and then i received a letter saying my medical certificate ran out on the 18 of november, i have never had a sick note in, as i won my tribunal in feb 2011 and i didnt received that letter until the 25th of november, i was told by esa that my case is still open, and my husbands job seekers allownace is on hold, can anyone help :blush:

I can see from your previous posts that you had problems with your previous assessment for ESA, which you had to appeal.

Have you indicated any intention to appeal on this occassion?

It sounds like you are/were getting Income Related ESA, if this is the case, then although the claim is in your name, it will actually be for you and your husband as a couple.

On the assumption, that his claim for JSA is also Income Related, then this could explain why there is a problem between the two.

If you are intending to appeal, then you will need to provide Fit Notes, see

thanks for replying so quickly, i am not going to appeal, i cant be bothered with all the hassle, like i said i did not receive the letter for over two weeks, they already stopped my money from the 14th of november, i was not told, that i could appeal when i phoned and asked why it has taken over two weeks to find out and have my money stopped.

You can appeal the vast majority of Decisions by the DWP, but of course the decision is yours.

If indeed there is a conflict between your "ESA" claim and your husbands JSA, then you will need to resolve this before his claim can progress.
