New diagnosis do I notify anyone? was created by Fleur33
Hi,
Since receiving my 5 year DLA award(thanks to this site)I have been diagnosed with Angina.Yesterday,I was diagnosed with unstable Angina.I explained to my GP how worried I am about having a medical, because I am also in receipt of SDA.My GP seems to think this new diagnosis will probably exempt me from medicals and put me in the support group for ESA.Is he correct in thinking this?
Thanks Amber.

Hi,
it is not the condition(s) that applies, more whether or not you meet the requisite descriptors for an award of ESA
be that in the WRAG or Support Group.
Without knowing a case in depth it is impossible to even guess if one should meet any of the descriptors. Hence we cannot say whether you would qualify for ESA or what group you could expect to be placed in.
If you read the guides to ESA in the members area, they contain the descriptors for both the WRAG and Support Group. You should be able to see for yourself whether or not you may meet those descriptors.

Thanks Pete,
Yes, I do seem to meet several of the descriptors but what worries me is that they wont bother reading anything that I have written and simply send me for a medical.Judging by what I have heard and read about these ATOS Doctors, they seem to pass you fit for work the majority of the time.
Because I have unstable Angina, I should not have any stress and was wondering if there is anything such as a letter off my MP that I could stick to the front of the form to make them read what I have written and telling them I meet the descriptors for the support group.
Thanks

Nothing on this board constitutes legal advice - always consult a professional about specific problems

You can certainly try a letter from your MP, see Contacting your MP
The ATOS "doctor" and the DWP Decision Maker are already obliged to read the ESA50 and any evidence supplied with it, however, they are also at liberty to assign their own weight to it in making a recommendation/decision.
You should certainly point out where you meet the Support Group criteria and why in your response, but unfortunately, if you'll forgive the analogy, you can lead a horse to water...
