Appeal Question

I recevied my letter for my ESA on the 18th December but it had 13 December on the letter so it had oviously been sitting there. It stated I am not entitled to ESA and my lasty payment of IB would be 28th December. i am going to put my appeal in but as it was christmas my local advice center is closed till tomorrow when I will go. What my question is from the 28th December to the date they receive my appeal will that money be back dated ?

Hi Philip

The date on the letter is merely administrative.

As ESA is intended to replace IB, and they are not benefits that can be paid together, you could be paid ESA from the date your IB stopped, should your appeal be succcessful.

As you are consulting a local advice centre, they will be able to ascertain all the facts of your case, which is not possible on a board like this.

Thanks. When they receive my fit not and start payimg me assesment rate will that go from the date that my IB stopped or will I not get that back till my appeal is in as they prob wont get my appeal for a few more days ?

Hi P,

You should make sure that your "fit note" covers you from the date of your final IB payment to ensure continuity.

They will not start paying you Assessment Rate of ESA, until they have received both your "fit note" and your appeal.

So even though it may be a back payment from the last payment of your IB, you should still receive the Assessment Rate ESA, as long as your fit note covers you from that date.

Remember that you only have 1 month from the date of the "fit for work" decison to submit your appeal.
