Got Decision Today

Hi jess, I scored 0 points at my medical and appealed. On the morning of my appeal I got a phone call to say the panel had decided I did not need to attend and placed me in the support group under reg 35

Thanks for that Susan, gives me a bit of hope. They totally disregarded my Consultant and G.P letters so I'm hoping common sense prevails before an appeal.

Hi Jessica, just to wish you good luck with your appeal. I don't know if it's different but I did an appeal several years ago when I was failed at my medical for incapacity benefit. The tribunal staff were very pleasant (there was no representative from the DWP although they occasionally do attend, just an independent Dr and lawyer) and it wasn't at all traumatic. They told me I'd already won as I'd submitted so much evidence from my Dr and therapist. I just walked in and out. Get as much evidence as possible and you have a good chance of winning.
Thank you ShootingStar, that's reassuring. I am a lot stronger now mentally after hearing what everyone has went through on here.

Hi Susan, can I ask if you drew attention to certain areas that you felt they overlooked and did you mention you felt under reg 35 you should be in the support group. Sorry for the questions but it's reassuring that others have went through the same and came out with the right outcome.

Hi J,
I'm not intending to butt in, and Susan may wish to answer also, but it is advisable to point out any information that you feel has been overlooked, in particular, with respect to the SG Descriptors.
If you also feel that you qualifiy for SG under Exceptional Circumstances, again point this out giving reasons why you feel that there would be substantial risk.
Remember that the appeal submission will first go to a different, probably more senior Decision Maker, who will look again over your case file and any new evidence.
