DLA for my child was created by paul mc garrie
cHi there what a great deal of advice on here really useful ,
but my question is i have a disabled child who has downs sydrome , and we have lost our mobility side of it ,
we are going to appeal as we got the letter from them today explaining why she has been refused the higher rate mobility is,
she can run out of a class room which will be no more than 20 feet ??
and she can walk 100 yards , even thought it might take us 30 minutes to go that distance ,
and the another reason is night time i have to take her to the toilet at night and we put around 11 oclock ,
quote from them (jodie is taken to the toilet at 11.00pm at night and then settles down in bed, this could reasonably consider to be before the household closed down for the night ) un quote but what we put was after 11.00 she gets up 3-4 times after that for no reason , and that she gets up at
6 am every day .
it can't be right that they only pick up on small sections of the entire form to make a judgement .

Unfortunately, the Decision Maker is entitled to choose the weight they apply to each piece of evidence, your job, in appealing, is in part to show that those choices are not reasonable.
