Working Tax Credits: Disability Element

Considering this is about work and benefits I thought I would as a question about work.
Im currently on ESA but im so fed up with not working despite im in so much pain, that im considering going self employed or getting a job.
Now I would be entitled to working tax credit, as my brother has just gone self employed and he gets full WTC at the moment whilst profits are down, but also because im on ESA and I have a condition which puts me in a predicament that I would find it hard to find a job, and the fact I have a list of problems, I can claim the disability element of WTC too.
Im just curious how you would go about claiming the disability element, and if anyone has, although I tick all boxes on the criteria.

Despite the name, we do not advise on working benefits.
As you are currently receiving ESA, are you sure that you are actually Fit for Work as you cannot normally receive ESA and work at the same time, so you would be required to close your ESA claim.
Whilst it is relatively simple to re-qualify within 12 weeks of closing your claim, if the break is longer you will in effect have to start a new claim.

If you are sure you want to come of ESA and work then the following link explains about Tax Credits and the requirement you would need to meet to be paid the disability element.

Im on ESA and I was in the support group, after m reassessment despite the fact I have got worse and more illneeses have arisen they put me in the WRAG..
So its starting to become very hard work to stay on ESA.
I hhave sent a very heated messgae to the deision maker asking them to justify themselves. and also sent them a letter based on the freedom of information act, asking them to send me all copies of correspondance from ATOS to DWP and vise versa, all paper work, medical evidence, ATOS reports, letters from doctors and consultants, everything DWP have looked at to decide my out come as this is a joke.
Also if I was to appeal the decision would someone like welfare rights represent me?

Yes you may be able to gain advice and reprsentation from a Welafare Rights organisation, such as The CAB etc, please see :

Please remember that you only have 1 month to appeal from the date of your ESA award letter, it may help if you review the ESA & Appeals sections of our : FAQ’s
