DWP Written Decision Delay After Call Rec'd was created by Augustus
5 weeks ago, I received a call from DWP telling me I was found fit for work. Since that call I have received no decision letter and when I ring I am told no decision or benefit disallowance has yet been recorded.
After my medical in December, where assessor had no access to my ESA50, I complained straightaway to ATOS/DWP. ATOS investigated, acknowledged my concerns, called assessor's report "superficial" and promised to write to DWP. DWP has never acknowledged my own letter.
Can anyone say whether, from what I write above, there appears to be anything amiss? Or could my complaints have finally filtered through to the DWP DM, and he/she is reconsidering?
If so, shouldn't DWP advise claimant if a recon. is being done outside appeal process?
If this is happening, would it affect my normal appeal rights after they give me a written decision?
Also, if they a reconsidering, given current timescales, could I be waiting many more weeks to receive a written decision?
Many questions I know. Hope someone can clarify things for me as sitting tight is hard in this case!

I am afraid that you are subject to the usual mis-information and error from the DWP call centre staff that seems to be becoming the norm.
You can't be found Fit for Work unless a Decision has been made, so one of the phone calls is in error.
It is possible that the acceptance of the ATOS report being in error has prompted a review of your claim, the important thing is to confirm that your ESA is still payment, if it is , then I would wait and see what results, however, if it is not, and you may mot recieve prior notice of of this, then you should contact the DWP immediately for an update.
