ESA65 & ESA 85a requests

ESA65 & ESA 85a requests was created by Francis
I was successfully transferred from IB to ESA Support Group without a medical in October 2010. I immediately wrote to ask for forms ESA65, ESA85a and a copy of ESA 113 by recorded delivery. Since then I have written again and phoned three times - to no avail.The people I spoke to on the phone could give me no info whatsoever and couldn't even understand when my next review is due. On all three occasions I was told that someone would phone me the next morning between 9am and 12 noon - but no one phoned. What on earth should I and could I do now ?
I really NEED to know when I am to be reviewed - as I am starting to become very anxious about the post arriving again.

If the DWP will not respond to your informal request for the documents then I would suggest that you make a formal request in the form of a Subject Access Request. There is a guide to doing this on the following link.

I did that at the begining of this month gordon but didnt recieve all of what i requested, just the ESA 85a and copies of the medical evidence I had sent them... I still await the scoresheet which is what I am really interested in seeing.. I got a reply after a few days but the forty days isnt up yet.. As soon as it is I will send another subject access request for the scoresheet.. I assume there isnt any issue with another request so soon given that what i asked for wasnt included the first time?

There is no restriction on your submitting a new SAR, however, the DWP may take the position that they have already provided the information requested.
Did you ask for all information, or a specific list of items, and if the latter, did this include a reference to a DMs score sheet or the equivalent?

Yes Gordon, I used the template for SARs from this site. The one that says i wished to see all info used in coming to a decision etc including *ESA 85a 113 etc if there was one ( there wasnt) and any scoresheets or notes used by or passed between ATOS and DM etc think everything was covered

Is it possible that there wasn't a score sheet done? I think I have read that from others on here who were passed on scrutiny.
I am under the impression that documents I need are the esa85a and LT54 (the decison maker's comments).
I was passed on scrutiny to WRAG and am appealing.
I put in a subject access request but am struggling to get these documents from the DWP even well after the 40 days.
Someone has been phoning the data department on my behalf and the staff are trying to be helpful. But they just cannot seem to get hold of the damn things! They have put in two requests to one of the DWP's offices for the forms. I am a bit worried that my papers have been lost.
But my MHP is going to keep on phoning about it.
