Also, if you were to have your decision reversed, at the beginning of the appeal, how soon after sending off the appeal form would you find out the outcome? Do they tell you whether you have been successful, or not with the review in the beginning, or do you only find out if you've been successful? Thanks.

Do quite a few people who appeal because they have been put in the WRAG instead of the support group have their decision reversed at the review (at the beginning of the appeal), or is the number only small?

Hi,
Claimants can only 'appeal' or ask for a reconsideration of their claim within one month of the decision on the claim being made. Obviously this limits the amount of claimants who can appeal/ask for a reconsideration of the decision.
Obviously there is always a risk, that any benefit awarded can be overturned on reconsideration/appeal.
We are not aware of the current figures for appeals etc as although they are available if you search Hansard, the statistics are always historical.
As to finding out the outcome ofr a reconsideration, it depends how long that takes - currently the DWP seem to be somewhat over capacity, hence it is not possible to estimate how long it may take. You would only find out the 'result' once the reconsideration has been carried out. If it is a negative result then if you asked for an appeal , your case papers would be forwarded to the Tribunal Service.

Hi R75,
Please see the information on the link below, regarding ESA claimant's success rate at reconsideration stage, from May 2010 to November 2011.
As you can see the success rate increased in 2011.
The figures do not indicate whether the reconsiderations were successful on "Fit for work" decisions, or WRAG to Support Group reconsiderations.

ive just been transferring over from IB to esa and put in the wrag group. i think i should be in the support group. i dont have the strengh to appeal and i have been reading for like 3 hours on this site for information. I would like to know , if anybody out there knows, what happens when wrag finishes, and your not fit to work? would you put on the income related esa? support group or is income support the only option? i ask as this will help in whether i risk appealing or not thanks
