From Incap. to ESA Work after ATSO canc my medical

I have been in receipt of Incapacity Benefit and D.L.A. from 2002 approx.

During January 2012 I received in the post a form to complete to transfer to ESA. I was then given a medical assessment date during Easter but got a telephone call and letter cancelling the appointment due to further medical evidence from my doctor.

On Friday 20th April I received a letter from the local job market saying I had been placed in the working group and to attend requested interviews.

I then telephoned the SSO and told them that I had not yet received a letter informing me of a decision. They looked at the file on the computer and told me that Incapacity Benefit had not yet written the letter but if I didn't like the decision to appeal.

I do not agree with the group I have been placed in and as I was not given a medical assessment what do I do next?

You need to continue pushing to receive a Decision letter, as you need to date of the Decision in order to lodge an appeal against it.

The fact the you did not have a medical is actually good news, as it means that the Decision Maker was able to make a Decision without one, and as a consequence, it lessens the risk associated with challenging the Decision.
