Do I follow appeal advice from DLA or BenandWorks? was created by hannahisabel
I am new to this so hope I am asking correctly...I have the nenefitsandwork DLA pack. I completed a DLA form using it in February. A decision to award nothing was subsequently sent back. I asked for it to be looked at again and they have said a complete no to anything yet again, despite A GP letter explaining how critical my conditions are.
My question is this...
The advice in the pack says to send a letter in for the appeal to say that essentially 'I feel I've demonstrated the reasons I need DLA and I don't feel the decision maker took into account how my illnesses affect my life - I would like to appeal', which I wrote out, exactly as the pack set it out.
I then, as recommended in the pack, asked for a GL24. However this requires me to write out very full details as to why I need DLA again. I called the DLA helpline and they told me to detail each and every need, as set out in the original form and re-justify why I need it for the appeal. Is this necessary? That's another day's work. Or do I simply write what is detailed in the pack and send that off?
I'm confused and would be really grateful for any advice / clarification.

I think your problems stems from your asking for a Reconsideration, even if that was not what you intended, rather than requesting an appeal from the outset.
Ideally you should complete the GL24 to request the appeal, however, you will now have to go into more detail on the form, however, this does not mean that you have to go into full detail.
I would suggest that you pick a number of important points from your original submission and in about a sentence explain why these justify the care and mobility needs that you believe you should be eligible for.
You can then, if you choose, submit more evidence and further detail once the case is submitted to the Tribunal Service.

Thank you for letting me know. I assume I should send out the letter asking for an appeal, contained in the pack then with this? I will add in the details about my conditions there and attach to the form if so. Again, any advice greatly appreciated.

Whilst you can appeal by letter it is better to do so using the GL24 as there can be no confusion in your intent.Thank you for letting me know.
