Hello all. I have searched but not found anything too specific to my query, hope you can help.ibrosis and receives the higher rate with the mobility. He has left Uni and has just been offered a job on the apprentiship scheme as an office accounts worker. He was given a medical via a home visit approx three years ago after he was on the higher rate for two years, he satisfied the Doctor who came to our home, he stayed on the higher rate and it was awarded indefinitely.

We are going to inform DWP of the new job but we are worried of the possible implications. Do you think this might trigger a review? He was most stressed before the visit and we are most anxious to avoid a repeat. The employment does not entail any physical work, just a desk job.

Also is it inevitable that he will be reviewed anyway due to the new rules? There is no cure for CF as yet and it is unfortunately highly unlikely he will improve. Any opinions/advice would be most welcome. Regards nomlas

The DWP tend to treat starting work as a potentially ‘relevant’ change of circumstances for DLA even though DLA does not depend on whether you are working and is not affected by how much you earn.

You therefore need to review your sons DLA claim forms to see whether anything that was stated in their is at odds with his working, for example; if he receives the mobility component, is this consistent with his gettting to and from work.

Many thanks Gordon. I dont think there is anything on his claim that should be a problem, he was at a normal school at the time and then went to Uni, all of which they were made aware of. He will be working for a close family friend who has known him all his life, in fact he is his Godson, and will be well looked after. Would this be relevant and if I explained all this in a letter to DWP do you think they would they take it into consideration? Also my second question, is a review inevetable anyway? Thanks again.

If the DWP have ignored his going to school and to university, then they may well also ignore his working, although I would make the point that I would expect that he is now being treated as an adult, and as a result the interpretation of the regulations is often tighter.

Whilst he remains on DLA, it is unlikely that he will be re-assessed with an indefinite award unless he is picked to participate in the Right Payments Programme, see

However, at some time in the next four years he will be transferred to PIP, the DLA replacement benefit, and will be re-assessedas part of the transfer.

Thanks again Gordon. Well we will just send all the details about the job and stress the no physical aspect of it also the close relationship between the Employer and himself.
