IB to ESA Migration - The Saga was created by Leste
I will try to keep this as simple as possible, but I've found out to myself and my wife's detriment how ruthless, uncaring, unfeeling and totally incompetent DWP/JC+/ATOS are.
Been on IB since 2000 due to Industrial Accident for fracture to left tibia and fibula with internal fixation and complications. 2008 fracture to right tibia and fibula with internal fixation and complications. 2010 Liver Disease - Cirrhosis of the Liver. 2012 Decompensated Cirrhosis of the Liver with splenomegaly diagnosed and Osteoarthritis in lower left leg.
2010 wife suffers first major heart attack with pneumonia. 2011 wife suffers 2nd major heart attack. Heart Failure diagnosed, Pacemaker installed. Hypothroidism, type 2 Diabetes, Retinopathy and Sleep Apnea, as well as occassional Odemas to legs and feet.
Received ESA50 in November 2011 from ATOS. Sent completed form back to ATOS 4 days before deadline by Recorded Delivery. Royal Mail tracking confirmed form was delivered and received by ATOS 1 day before deadline.
February 2012 heard nothing from ATOS not even a letter of confirmation that they had received ESA50. Phoned ATOS. ATOS said they had not received ESA50 and would be stopping my IB for 6 weeks commencing in 3 weeks time. I argued that I had sent it in and had a Royal Mail receipt to prove it, with the tracking number. ATOS tells me to send in a letter confirming the conversation and a copy of the Royal Mail receipt, and request a reconsideraton as a good cause for sending ESA50 late. Told them that it was not sent back late, it was ATOS that had not processed it on time. So I send in the letter, photocopy of ESA50 and Royal Mail receipt. Heard nothing in writing or by phone. Telephoned ATOS again. Given run around. They had sent my file to JC+ & I had to contact them there, which I did. Was told person dealing with my ESA50 unavailable as was on leave and would not be back for 2 weeks and to call back then. Waited the 2 weeks, heard nothing. I Phoned back. Person dealing with my claim hadn't got round to my claim, told to phone back next week.
Got sick of the run-around, contacted my MP who magically, within one week, got the sanction overturned, an apology from DWP (but not from ATOS)or JC+. First part of the saga doesn't end there. ATOS/DWP/JC+ forget to update their computer records. Receive a demand from Council saying that HB/CTB had been stopped, as IB had stopped, and that my wife and I owed hundreds in Rent and Council Tax. Managed to get that sorted out, with letters from MP confirming that IB had been reinstated. Then I decided to join this website, which I had not heard about before.
Part 2 of my IB to ESA Migration tomorrow.
Any comments or advice would be greatly appreciated.

Welcome to the forum, you might want to have a lok at the following FAQ, which explains how to navigate the site.
Welcome to Benefits and Work
We have had several members with "lost" ESA50s before and after last years Christmas period, so you have my sympathy.
I assume by part 2 of your migration you are referring to an ESA medical, at such short notice, there is little practical advice I can give, the following FAQ may be worth a look
ESA Medical – What to expect
You might also want to have a look at our ESA Claim guides, whilst it is obviously too late to re-write your ESA50, they may suggest some alternative ways of explaining how you meet the ESA descriptors which would be of use when talking to the ATOS "doctor".
Unfortunately, the forum is not open to new posts again until tomorrow afternoon, but if that is not too late, please come back to the forum with any specific questions you might have.
Good luck
