Since my IB was stopped in February and I have been waiting for my ESA appeal I have been sending in sick notes to the DWP and have been receiving benefit at the basic rate. Now if my appeal is heard and I fail what happens if I keep submitting sick notes?

If your appeal fails, your ESA claim will be terminated and 'Fit notes' will not change anything - other than possibly allow you to impose certain conditions if you decide to claim JSA.
I am not sure of the conditions that would need to be met in order to reclaim ESA - I'm sure one of the other mod's will be along to advise.

You should be able to make a new claim for ESA, six months after the Decision you appealed ( not the date of the Tribunal), your GP will need to continue to supply you with Fit Notes until a Decision is made on this new claim.
