Hi everyone,
Just wanted to vent a bit of angerto be honest!!
I was on cb esa up until 30th april but had a medical assessment on the 28th March.
Had the result of the medical in May and was awarded 6 points out of the 15. I appealed against this decision and sent the appeal form recorded delivery and received a letter dated 18th May to say it would be looked at.
I went to my job centre this morning because i have yet to recieve any money ( thought i would be put on assessment rate) and was told that it would be paid in credit - my ni would continue to be paid but i would not recieve anymore payments. If the appeal was overturned then i would get something but was told this could take months.
Now, i am not entitled to income related pay as my husband earns too much but i find it very unfair that i won,t recieve any money even though hospital and doctors are stating i am unfit for work. Also sent a medical note with appeal form stating this.
I now have to wait, with no money, until the dwp find the time to look at my appeal and then decide.
Am i the only one who thinks this wrong and unfair???

I agree not fair, but new rules were passed recently, sorry my memory not great, but the link to them is on this sight, am sure one of the Moderators will remind us of link, was 100 plus pages!

I am afraid that once your entitlement to ESA(CB) ceases because of the 365 day rule, you will not receive any further payments, even when appealing.
If you win your appeal and you are placed in the SUpport Group, then your payments will be re--instated.
If you are placed in the WRAG you will only be entitled to NI Credits that count towards a full State Pension.
Once more than 12 weeks have elapsed Since you lost your entitlement to ESA(CB), you can make a new claim for ESA(CB), providing you can meet the NI Contribution requirements.

Just feel very let down, such a lot going on and seem to be nothing i can do about it all.

This was part of the Welfare Reform Bill which was pushed through by the government this year despite strong opposition.
