About 6 weeks ago i received the dreaded esa 50 form from Atos , after filling it in with all the details they required, i sent it back . In the mean time i spoke to my GP with my concerns . he was fully supportive of my case, and gave me a letter stating in his opinion, i should be placed in the support group , due to being in the Wrag could have an severe effect on my health .
i believed that i was due to have another medical , where i could have supplied this evidence, but i did not need a medical this time and was told i wouldn't need another medical until nov 2013 .
My question is . should i ask for the decision make reconsider their latest decision with regard to the doctors report ? and would it make any difference anyway , as i was told also today that my esa would stop on the 30th sept . any help please

Forgive me, george, but I am a little confused by your post.

Are you currently in the WRAG or Support Group?

If you are in WRAG then your contributary ESA will end after 365 days, you might be entitled to income-related benefit.

If your are in the support Group then this is not time-limited.

Do you mean that a decision was made without a medical this time? If so, did you not send your doctor's report in with your ESA50?

How long ago was your last decision made?

sorry if i confused you .

At the moment im in the WRAG , but this im appealing against as well as my dla award . with regard to the latest atos medical . i filled the esa 50 form in ,and they decided i did not need a medical this time .
i still have the letter from my doctor here at home .

Obviously the decision is yours, but you can appeal the Decision to place you in the WRAG using this letter as evidence.

Howevr, you need to be aware that to qualify under the Exceptional Circumstances, and in particular that Work Related Activity would be dangerous to your health, you must provide compelling evidence that this is the case as the burden of proof lies with you.

Being placed in the Support Group would allow your ESA(CB) to continue being paid, but this is in itself not reason to appeal.
