I'm no legal expert, but Judge Mesher's ruling as cited by Condor seems to be pertaining to ESA claims linking rules?

With regard your appealing, seeToday i have just recieved a letter stating that i have been put in the ESA WRAG from IB and i have not attended a WCA,i gather the decision was made based on the medical questionaire, i need to be in the support group and will need to appeal,if i do and iam not successful do i stay on in the WRAG?Also given what has been said should i have had a WCA,before they decided to put me in the WRAG group.
Is there any risk to challenging a decision?
How long do I have to appeal?
How to submit an appeal

Do I have to attend WFIs while I appeal?
The Tribunal can place you in the Support Group, leave the original Decision unchanged in which case you will remain in the in the WRAG, or finally remove the award completely, however, in this case, they must offer you the opportunity to remove your appeal before making this Decision.
To be clear regarding claimants "needing" to attend a WCA. At this time the only circumstances that we are aware of where a Decision cannot be made without a WCA being held, is a Fit for Work decision.

The good news is I won my appeal on the Mobility Descriptor :)I am now in The Support Group. If you live in Devon/Cornwall and need a good representative get in touch with me and I will give you a contact number, his services do involve a fee.

Hello everyone, just to update you on my ESA wrag to Support group appeal, I attended tribunal earlier this week to continue from being adjourned some 6weeks or so ago, the Judge mentioned this was my second appearance but didn't go into detail about why my appeal hearing was adjourned,after the adjournment I wrote to the DWP to inform them what had occured as instructed by the appeal judge but to date I have had no reply from them.
The good news is I won my appeal on the Mobility Descriptor :)I am now in The Support Group. If you live in Devon/Cornwall and need a good representative get in touch with me and I will give you a contact number, his services do involve a fee.

Well done on winning your appeal and for being placed into The Support Group. You're the fifth member to be placed in The SG today, as the result of a revision or appeal decision.

I gather that you mean The Mobilising Descriptor, but who cares.
