i am a new member and i have been placed in the wrag group of esa and i know i should be in the support group and i am going to ask for a review,should i state the reasons as to why i am asking for a review in my letter,i have not asked for a copy of my atos report or reasons from the decision maker as to why i have been put into wrag,should i also do this before i write asking for a review,because after reading the sites descriptors about support group requirements i think i qualify on def 1 poss 2 or 3 of the descriptors after what i said at my atos medical regards bigbird

We would recommend that you use a GL24 Appeal form rather than writing a letter to the DWP. See

You need to be aware that there is a risk to challenging a Decision.

You will need to state your reasons for appealing, as you are in the WRAG your payments are not effected so you should have time to request the information used to make the Decision from the DWP.

thanks for your help and advice gordon its much appreciated,i do have further questions to ask:i am asking for a review 1st because i have a speach impediment and going to a tribunal appeal would be only if i have too, i,m not to well to start with and the extra pressure of having to give verbal evidence is very daunting to me,i was wanting to ask if after asking for a review and i was still put in the wrag group could i still ask for a tribunal appeal and would i have another month from the date my review was turned down to appeal or should i state in my letter that pending a refusal to put me in the support group after a review i will be appealing,also i have been told that by someone that after a year on wrag were i to continue to be unfit for work i would recieve no more benefit of any kind,is this correct

Yes, you can lodge an appeal after a Reconsideration has been made.

Whilst the Decision is yours, we always recommend lodging an appeal from the outset, if nothin else it will save you time if the Reconsideration is not successful. An Appeal can be withdrawn at any time, so if you find you cannot pursue it you can simply notify the Tribunal Service, alternatively you can request a Paper Appeal, although the success rate for this over an Oral hearing, is significantly less.

Bigbird, you are correct that your ESA would be means tested after 365 days in the WRAG.
