A little PIP confusion was created by mommaduck
I understand that PIP comes into process in April next year and all current claimants on DLA, 16 year to 64 years of working age will have to undergo at some point a re-assessment via PIP.

Is someone who retired (on paper I had to stop work at 40) at 60 (me) and claimed State Pension at that time still considered to be of working age and therefore likely to be re-assessed?

It is rather unfortunate that I will be 65 one month later in May 2013 so may have missed this initial process.

I understand that eventually all current DLA claimants of the age stated will be re-assessed but is any criteria known at the moment as to what age group they will be starting with?

I am concerned that they may start with the oldest and obviously worried that under the new rules I may have to surrender my Motability vehicle as it appears that only full time wheelchair users (not able to walk at all) will qualify for the higher rate mobility.

Another question I have is that under the current scheme (DLA) you have to claim before 65 otherwise the claim is for Attendance Allowance which does not have the mobility component.

When the PIP comes into force, and I have at some point got to submit a claim for the same, is the mobility component available for all PIP claimants or just those under 65? If this is the case I will lose it anyway. At the moment I am on High Rate Care and Mobility. I have a lifetime award and my mobility component is currently set until my 80th birthday should I live to that age :S

Hi md,

We are not currently aware of any exceptions, see this extract :

"DLA will remain available to those 65 or over on 8 April 2013 (the day that PIP is introduced)"

If your questions are not answered by the referenced document then it is unlikely that we can provide any further information.

The phrase "working age" is often misunderstood in the context of PIP, the criteria for transfer are based solely on a claimant age (e.g. 16-64).

The legislation enabling the changeover to PIP from DLA, has not even been presented, and it will be this that specifically defines who is to be transferred, so until this is made available to the public, it will not be possible to state how those who will be 65 on or around the time that PIP is introduced will be effected.

Whilst the Government have indicated that they intend to look at the under 16s and the over 65s after the initial phase has been completed, there are no details of what their thinking on this subject is.

As we understand it, the transfer will be in phases, with new claims being first, re-newals second, and indefinite awards last, however, there will undoubtedly be some divergance from this order in order to maintain throughput, it is to be hoped it doesn't descend into the sambles that the IB to ESA transfer has.

It looks as though you might be caught between two stools on this one, but so far the DWP information machine is operating at its usual level of helpfulness.

I suggest that you write to your MP. Tell him or her about your circumstances, and how worried you are that you might lose out badly because of the cut off dates.

They may be able to get some clarification from the DWP, or even lobby for better transitional arrangements.
