I have an ESA50 to complete
I have got a letter from the GP that deals with
mental health, outlines the diagnoses, the long history,
the problems previously with managing work in relation to it, and given the view that a substantial risk of harm tro the health of myself or other people would result if found fit for work related activity.

It does outline a basis for this but I know I could consolidate it with more information and evidence.

Now, could I send this GP letter to ATOS/DWP and ask if they still want the ESA 50 completing or has sufficient been provided, or would it be best to simply enclosed it with ESA 50 I'm a bit worried that if I send the letter alone and ask if this is enough I will look like a pushy type and get their back up

You should still complete the ESA50 to the best of your ability, then send your GP's letter with it.

Just to re-iterate what has been said in previous posts, your claim is being reviewed as part of a process, if you do not participate in that process in the expected manner, you run the risk of your claim failing.

There is nothing wrong with hoping for the simplest and quickest assessment, but you must plan for the hardest and longest.

Is it possible that by sending this letter on its own, you can avoid an assessment, yes! Is it likely, probably not!

Will your not returning the ESA50 effect your claim, in certain circumstances, no! Is it possible that ATOS could return your file to the DWP, for non-conformance, yes!

I'm not taking any risks. Thats why I got the GP to do a letter and am using a PDF ESA 50 to accommodate more information, and probably will add a letter and possibly other evidence as well
I will send the form in time with the letter and what other stuff seems helpful
Gosh no I wont take any risks with the time limit but in mental health cases they have to carry on with the WCA process even if you fail to return ESA50, but of course this means you haven't had your 'say' in writing and will probably get an invite to a medical

Just to be clear, whilst this is a common practice, it is not defined in the ESA legislation! It is not done in all cases where the claimant has Mental Health issues, and as far as I am aware there is no "list" of which cases it should be applied to, and whilst you should be asked to provide Good Cause for failing to return your ESA50, these things often take months to resolve.
